DMCA
At Xyvin (https://xyvin.xyz), we respect the intellectual property rights of creators, developers, and publishers. We comply with the Digital Millennium Copyright Act (DMCA) and will respond promptly to claims of copyright infringement reported to us.
This DMCA Policy explains how copyright owners can report alleged infringements, how we handle notices, and how users may respond with a counter-notice if they believe material was removed in error.
1. Reporting Copyright Infringement
If you believe your copyrighted material has been used on Xyvin without authorization, you may file a takedown notice. To be effective, your notification must include the following information, as required by 17 U.S.C. § 512(c)(3):
-
Your Signature – A physical or electronic signature of the copyright owner or an authorized representative.
-
Identification of Copyrighted Work – A detailed description of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
-
Location of Infringing Material – The exact URL(s) of the allegedly infringing content on Xyvin. General references to the website are insufficient.
-
Contact Information – Your name, mailing address, telephone number, and a valid email address.
-
Good Faith Statement – A statement confirming that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
-
Accuracy & Authority Statement – A statement that the information in your notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
2. Where to Send Your DMCA Notice
Send your completed notice to our designated copyright agent:
📧 Email: [your-email@xyvin.xyz]
📍 Mailing Address: [Insert address if available]
3. Counter-Notice Procedure
If you believe that your content was removed or disabled in error, you may file a counter-notice. To be valid, a counter-notice must include:
-
Your physical or electronic signature.
-
Identification of the material that was removed, including its original location on Xyvin.
-
A statement under penalty of perjury that you have a good faith belief the removal or disabling was a result of mistake or misidentification.
-
Your name, address, telephone number, and email address.
-
Consent to the jurisdiction of the federal court in your district, or if outside the United States, consent to jurisdiction where Xyvin operates.
When we receive a valid counter-notice, we may reinstate the content unless the original complainant files a court action within 10–14 business days.
4. Repeat Infringers
Xyvin maintains a policy to terminate or restrict access to users who are repeat infringers. We may also remove content at our discretion if we believe it infringes intellectual property rights.
5. Misrepresentations
Please note that under the DMCA, any person who knowingly submits a false claim of infringement or counter-notice may be held liable for damages, including legal costs and attorney’s fees.
6. Our Commitment
We take copyright compliance seriously and aim to balance the rights of creators with the interests of our community of players. Our goal is to foster a safe and fair environment where developers, publishers, and players alike can enjoy and share digital content responsibly.
